Terms of Use

I. Introduction and Acceptance

These Terms of Use ("Terms") constitute a legally binding agreement between you and BlueSphere Security Ltd, registered in England and Wales ("BlueSphere", "we", "our", or "us"), regarding your access to bluesphere.dev (the "Site") and the BlueSphere PTaaS Platform (the "Platform").

If you are accessing the Platform as a representative of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms. If you do not agree, you must not access or use the Site or Platform.

II. About the BlueSphere PTaaS Platform

BlueSphere provides enterprise-grade cybersecurity services through its PTaaS Platform, including:

• Manual penetration test management and project tracking
• Automated SAST security scanning powered by BlueAI
• API security testing and vulnerability detection
• Compliance automation: PCI-DSS, ISO 27001, GDPR, SOC 2, PIPA
• Vulnerability reporting, risk scoring, and remediation tracking

III. Eligibility & Account Registration

The Platform is intended for businesses and professionals. By accessing it, you represent that you are at least 18 years old, acting on behalf of a legitimate business entity, with the legal authority to enter into these Terms. All registration information you provide must be accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at Service@bluesphere.dev of any unauthorised access or security breach.

IV. Use Restrictions

You agree that you will not, under any circumstances:

• Use the Site or Platform for any unlawful purpose or in violation of applicable law.
• Attempt to gain unauthorised access to any part of the Site, Platform, or connected systems.
• Use automated tools, bots, or scrapers without prior written consent from BlueSphere.
• Conduct security testing on systems for which you lack explicit written authorisation.
• Transmit malware, viruses, or code designed to damage or disrupt systems.
• Bypass any security measures, access controls, or robot exclusion mechanisms.
• Attempt to reverse engineer, decompile, or disassemble any component of the Platform.
• Provide false or inaccurate information when registering or using the Platform.

V. Intellectual Property

BlueSphere Security Ltd and its licensors retain all intellectual property rights in the Site and Platform, including all software, designs, text, logos, and trademarks ("BlueSphere IP"). Nothing in these Terms grants you any right beyond the limited right to access and use the Site and Platform in accordance with these Terms.

You may not copy, reproduce, modify, adapt, distribute, or create derivative works from any BlueSphere IP without prior written consent. Any feedback or suggestions you provide may be used by BlueSphere without restriction or compensation.

VI. Confidentiality

In the course of using the Platform, you may access confidential information including security findings, vulnerability reports, penetration test results, and sensitive data. You agree to:

• Keep all such information strictly confidential.
• Not disclose confidential information to any third party without BlueSphere's prior written consent.
• Use confidential information solely for the purposes for which it was provided.

VII. Disclaimer of Warranties

THE SITE AND PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY, OR NON-INFRINGEMENT. BLUESPHERE DOES NOT WARRANT THAT THE SITE OR PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

VIII. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BLUESPHERE'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

IX. Indemnification

You agree to indemnify and hold harmless BlueSphere, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising from: your use of the Site or Platform; your violation of these Terms; your violation of any third-party rights; or any User Content submitted by you.

X. Modifications & Termination

BlueSphere may modify these Terms at any time by updating the "Last updated" date. Your continued use of the Site or Platform constitutes acceptance. BlueSphere may also suspend or terminate your access at any time, with or without cause. Provisions that should survive termination will do so.

XI. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

XII. General Provisions

• Entire Agreement — These Terms, your Customer Agreement, and our Privacy Policy form the entire agreement between you and BlueSphere.
• Severability — If any provision is invalid, the remaining provisions remain in full force.
• Waiver — Failure to enforce any right is not a waiver of that right.
• Assignment — You may not assign rights without BlueSphere's prior written consent.
